Welcome to MammyHug. These Terms of Service ("Terms") govern your access to and use of our website, products, and services (collectively, the "Services"). By visiting our site or purchasing from us, you agree to these Terms.

If you do not agree, please do not use the Services.

1. Eligibility & Account

  • You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Services.
  • You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.

2. Products, Availability & Pricing

  • We may change, limit, or discontinue products, collections, or prices at any time without notice.
  • We try to display colors, textures, and details accurately. Product images are illustrative; minor variations may occur due to different displays, production batches, or natural-material tolerances.
  • Prices are shown in the selected currency (where available). Taxes, duties, and import charges may be added at checkout or collected on delivery depending on your destination (see Section 7 and our Shipping Policy).

3. Orders & Acceptance

  • Submitting an order constitutes an offer to purchase. We may accept, reject, or limit any order at our discretion (e.g., suspected fraud, inventory errors, shipping restrictions, misuse of discounts, or other reasonable grounds).
  • If we cancel after you have been charged, we will refund you in full for the canceled items.
  • No custom or personalized orders. We do not accept individual/custom-made orders, made-to-order requests, or requests to alter products (e.g., changes to size beyond available options, length adjustments, fabric/composition changes, color substitutions, adding/removing details, or other modifications).
  • All products are sold as described and as available. Where options exist (e.g., size or color), only the options shown on the product page are available for purchase.
  • Estimated shipping dates shown at checkout are indicative and may change due to carrier delays, customs, or operational constraints. If a significant delay occurs before dispatch, you may cancel the order for a full refund.

4. Accuracy of Information

  • We use reasonable efforts to keep content, pricing, availability, sizing, and care information current and accurate, but errors may occur. We reserve the right to correct any errors or omissions and to change or update information without prior notice, including after you have submitted an order (subject to refund/cancellation rights where applicable).

5. Payments & Billing

  • Payments are processed securely by third‑party providers. By submitting payment information, you authorize us and our providers to charge the total amount of your order.
  • You agree to provide current, complete, and accurate purchase and account information.
  • We may request additional verification (e.g., identity or address) before accepting an order.

6. Returns, Exchanges & Refunds

  • For EU/UK consumers: your statutory withdrawal rights (cooling‑off) and mandatory consumer rights are not affected by these Terms. See Section 10.

7. Shipping, Delivery & Risk of Loss

  • Shipping options, timeframes, and fees are described in our Shipping Policy.
  • Unless otherwise stated, international shipments are DAP (Delivered At Place, Incoterms® 2020): local authorities may collect import VAT, customs duties, brokerage, and handling fees at delivery; you are responsible for these charges.
  • Risk of loss passes to you upon delivery to the shipping address provided. Title to products passes upon our receipt of full payment.

8. Promotions, Coupons & Gift Cards

  • Promotions and coupon codes are subject to the specific terms presented; they are non‑transferable, have no cash value, and may be limited by time, geography, or product category.
  • We reserve the right to cancel or amend promotions at any time in the event of error, abuse, or unforeseen circumstances.

9. Intellectual Property & Acceptable Use

  • All content on the Services (including text, graphics, logos, images, video, designs, and code) is owned by or licensed to MammyHug and is protected by intellectual‑property laws.
  • You may not reproduce, duplicate, copy, sell, resell, reverse engineer, or exploit any part of the Services without our prior written permission.
  • You agree not to use the Services for unlawful purposes, to interfere with their operation, or to attempt to gain unauthorized access to any systems or data.

10. Consumer Rights (EU/UK)

  • If you are a consumer in the European Union or the United Kingdom, you have a 14‑day right of withdrawal for distance contracts. Details on how to exercise this right and who pays return shipping are set out in our Return & Refund Policy.
  • Nothing in these Terms limits non‑waivable statutory rights under applicable consumer‑protection law in your country of residence.

11. Warranties & Disclaimers

  • Except as expressly stated, the Services and products are provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non‑infringement.
  • Natural fiber garments may shed, pill, or vary slightly; follow the care instructions provided.

12. Limitation of Liability

  • To the fullest extent permitted by law, we (and our officers, directors, employees, affiliates, agents, and suppliers) shall not be liable for any indirect, incidental, special, punitive, or consequential damages, or for any loss of profits, revenues, data, or use, arising from or related to your use of the Services or purchase of products.
  • Our aggregate liability to you for any claims relating to the Services or products shall not exceed the amount you paid for the product(s) at issue in the 12 months preceding the claim.
  • The above limits do not exclude or limit liability that cannot be excluded under applicable law (e.g., for death or personal injury caused by negligence).

13. Third‑Party Services & Links

  • The Services may link to or integrate third‑party websites, tools, or apps. We are not responsible for third‑party content, policies, or practices. Your use of such services is at your own risk and may be subject to additional terms.

14. User Content & Reviews

  • If you post reviews, comments, photos, or other content, you grant us a non‑exclusive, worldwide, royalty‑free license to use, reproduce, modify, publish, translate, and display such content in any media for marketing or operational purposes, subject to our Privacy Policy.
  • You are solely responsible for the content you submit and you represent that you own or control the rights to it and that it does not infringe the rights of any third party or violate any law.

15. Privacy & Cookies

  • Your submission of personal information is governed by our Privacy Policy.
  • We use cookies and similar technologies as described in our Cookie Policy (where available).

16. Export & Sanctions Compliance

  • You agree to comply with all applicable export control and sanctions laws and not to purchase or use the Services if you are subject to any government‑issued sanctions or restrictions.

17. Force Majeure

  • We are not liable for delays or failures caused by events beyond our reasonable control, including acts of God, war, terrorism, labor disputes, pandemics, supply‑chain disruptions, or failures of suppliers or carriers.

18. Termination

  • We may suspend or terminate your access to the Services at any time for any reason, including actual or suspected violation of these Terms. Sections that by their nature should survive termination shall survive (e.g., IP, disclaimers, limits of liability).

19. Changes to the Terms

  • We may update these Terms from time to time. If we make material changes, we will post the updated Terms and update the “Effective date” above. Continued use of the Services after changes take effect constitutes acceptance of the updated Terms.

20. Governing Law & Dispute Resolution

  • These Terms are governed by the laws of the United States and the State of Florida, without regard to conflict‑of‑law principles.
  • Where permitted by law, the parties agree to seek an amicable resolution first; if unresolved, disputes shall be brought in the state or federal courts located in Florida, USA. You and we waive any objections to such venue and jurisdiction.
  • If you are a consumer resident in the EU/UK, you may also be entitled to bring proceedings in your country of residence and to access EU consumer dispute‑resolution mechanisms; your mandatory statutory rights remain unaffected.
